Consumer Law Class Actions

Representative examples of consumer protection lawsuits Sidney Childress has filed and successfully settled include:

  • class-action suit against a large apartment project in Austin, Texas, owned by an absentee California slumlord. The property owner did not have on-site management (just a drop box for rent payments), would not spend any money to maintain the property, the property was infested with crime and graffiti and affected property values in the surrounding neighborhood. This slumlord was forced to undertake graffiti-abatement and remediation measures, and to install smoke detectors, door-viewers and other mandatory security devices in all apartments. The named Plaintiffs received monetary settlements.

  • class-action suits against multiple mobile home parks and large apartment complexes in Austin, Texas who improperly billed renters for sub-metered water. The first of these cases came to Sidney Childress's attention as a result of a renter, who was being evicted, coming to see Sidney for help. The property manager didn't like this renter so she charged him more for his water. When he protested and wouldn't pay the excessive billing, the manager started eviction proceedings. Settlements in these cases affected over 4000 residential leases in Austin, Texas.

  • multiple class-action lawsuits against consumer debt-collection agencies who engaged in illegal credit-reporting activities;

  • suit against used car dealers and “payday lenders” who engaged in predatory lending practices, including failure to comply with the Truth in Lending Act.
